I hope I'm not a h8er. I don't think I am.
My problem with this whole Prop 8 thing is this: this country is based on the rights of individual people, straight, gay, indifferent, whatever...it's about people, and things come up, and things are voted on. And if you are going to base a country upon the will of its citizens I think you have to take into account the way they vote on things. I'm not saying I agree with the way they collectively vote, and I'm not saying you should either. Just thinking that if you're going to do anything more than pretend we have a democracy, you have to listen to the little ticks in the voting booths when things like this happen. I don't like the idea of a state which can take the feelings of 7-plus million voters and hand-pick a judge who can study the voting and overrule it. That seems like a gross lack of representation. I'm not questioning your heart's intents in this, C. I truly am NOT doing that. I just mostly wonder where, if the voting populace doesn't matter in a case like this, it ever WILL matter.
m, great point.

i agree with you. the voice of the people should never be taken lightly. some of the other propositions up for vote: legalization of marijuana; restricting greenhouse gases; safe drinking water supply act - these are examples of things the people should vote on my issue is that THIS proposition should not have been on a ballot in the first place. marriage is a fundamental right, protected by the 14th amendment. judge walker's ruling is that prop 8 was altogether unconstitutional. there is a reason why amending the constitution is no small task - it must stand up to the test of time, regardless of the "popular" views of the era. if a law is ruled unconstitutional, it should be removed, or the constitution should be amended. now we go into the court of appeals and i'm waiting to see what happens from there thank you m. you've given me more to think about. please continue sharing your thoughts with me :) |
